What Is Title?
Title is
the combination of all elements that constitute the
legal right to own, possess, use, control, enjoy,
and dispose of real estate. It is a right of
ownership recognized and protected by law.
What Is Title Insurance, and Why Do I Need It?
An
insurance policy--protecting against loss should the
condition of title to land be other than as insured.
Title Insurance is indemnity against loss resulting
from defects in or undisclosed liens upon a title.
You need Title Insurance to protect possibly the
most important investment you'll ever make - the
investment in real estate. A lender goes to great
lengths to minimize the risk of lending money for
the purchase of real estate. First, credit is
checked as an indication of the borrower's ability
to repay the loan.
Then,
the lender seeks assurance that the quality of the
title to the property to be acquired and which will
be pledged as security for the loan is satisfactory.
The lender does this by obtaining a loan policy of
title insurance.
If
my lender gets title insurance for its mortgage, why
do I need a separate policy for myself?
The
lender's policy covers only the amount of its loan,
which is usually not the full property value. In the
event of an adverse claim, the lender would
ordinarily not be concerned unless its loan became
non-performing and the claim threatened the lender's
ability to foreclose and recover its principal and
interest. And, in the event of a claim there is no
provision for payment of legal expenses for an
uninsured party. When a loan policy is being issued,
the small additional expense of an owner's policy is
a bargain.
